Asuno Products are sold by Wire Salad OÜ (company reg. No. 16105764), registered address Harjumaa, Tallinn linn, Hobujaama tn 4, 10151 Estonia, European Union (“Company”, “we”, “us” or “our”), which is the seller of record for all Subscriptions purchased through our Website.
1. About Subscription Cancellation Policy
1.1 This policy explains how an ASUNO Subscription works, how to cancel future renewals and what happens after cancellation. It applies to consumers in the European Union, European Economic Area, United Kingdom, United States, Canada and Australia.
1.2 This policy forms part of, and must be read together with, the Terms of Sale and the Returns & Refunds Policy that apply in your country. Words defined in the Terms of Sale have the same meaning here. In this Policy, an “Order” is a single purchase; a “Subscription” is an arrangement under which Orders recur automatically until cancelled; a “Subscription Order” is an individual Order supplied under a Subscription; a “renewal” is the automatic recurrence of a Subscription Order; and a “Product” is an individual unit you buy from us.
1.3 Sections 2 to 12 apply to every customer. Section 13 sets out additional provisions for particular countries, and where Section 13 differs from an earlier Section, Section 13 prevails for customers in that country. Consumer law is not the same in every country, and in some cases not the same in every state, province or territory. This Policy does not attempt to state every right available to you. You keep every right that cannot be waived by agreement under the law where you live, and where any provision of this policy or of the Terms of Sale conflicts with such a right, that law prevails and the rest of this policy continues to apply.
1.4 Cancelling a Subscription is not the same as returning a Product or asking for a refund on a particular Order. Returns, refunds, defective Products and delivery problems are dealt with in the Returns & Refunds Policy for your country, and where you want both, you must ask for both.
1.5 Nothing in this Policy limits any mandatory consumer rights that apply to you. If this Policy conflicts with a right that cannot legally be excluded, that right will apply.
1.6 Prices are charged in the currency shown at checkout.
2. How a Subscription works
2.1 A Subscription renews automatically at the frequency you select at checkout, and we charge your payment method the recurring price shown for your plan, on an ongoing basis, until you cancel. There is no fixed term, no minimum number of Subscription Orders and no minimum spend.
2.2 Before you subscribe, and before we collect your billing information or charge you, we show you clearly and conspicuously: (a) the Products included in each Subscription Order, (b) the recurring charge, (c) the billing frequency, (d) the shipment frequency, (e) the fact that the Subscription continues and renews automatically until you cancel, and (f) how to cancel.
2.3 Your consent to a Subscription is given only by that separate, affirmative step – submit an Order.
2.4 After you subscribe, we send you confirmation by email setting out your Subscription plan, the recurring price, the billing and shipment frequency, your next renewal date, the automatic renewal terms and how to cancel, in a form you can keep. Please keep this email for your records.
2.5 Each Subscription Order contains the Products shown for your plan at checkout. The recurring price shown at checkout includes applicable taxes. Where a delivery charge applies to your plan, it is shown to you before you confirm your Subscription and is charged with each Subscription Order.
3. Charges, processing and delivery
3.1 Your first payment is taken on the date shown at checkout. Each later payment is taken on the renewal date for your plan, at the frequency you selected, until the Subscription is cancelled. Your plan, recurring price, billing frequency and next renewal date are stated in your Subscription confirmation.
3.2 We begin preparing and packing a Subscription Order after the payment for that period has been taken.
3.3 Each payment covers the Products included in that Subscription Order. Delivery times, delivery charges and your rights if an Order is delayed or not delivered are explained in the Returns & Refunds Policy for your country.
4. How the Subscription price is allocated
4.1 If one Subscription payment covers more than one Product, we allocate the amount paid proportionately between those Products. If the Products are equally priced, the payment is divided equally between them. For example, if you pay 50 in the currency shown at checkout for two equally priced Products, each Product has a paid value of 25 in that currency.
4.2 Each Product supplied under a Subscription is a paid Product. It is not treated as free merely because its allocated Subscription price is lower than its standalone price.
4.3 Any refund, credit or other amount relating to a particular Subscription Product is based on the proportionate amount actually paid for that Product, as explained in the Returns & Refunds Policy for your country.
5. How to cancel
5.1 You may cancel your Subscription at any time without giving a reason. Cancellation is free, and we do not charge a cancellation, exit or administration fee.
5.2 You may cancel by either of the following, both of which are available online: (a) our online contact form at https://asuno.com/pages/contact; or (b) an email to support@asuno.com.
5.3 Please include the email address used for the Subscription and, if you have more than one Subscription, tell us which one you are cancelling. We may take reasonable steps to confirm that a request comes from the Subscription holder, such as replying to the email address held on the account. We use verification only for that purpose and do not ask for unrelated personal information.
5.4 We may explain what cancellation means for your next Order or make you an optional offer to continue your Subscription. Any such information or offer is given once.
5.5 We will process your request without undue delay and send you an email confirming the effective cancellation date. Please note that your cancellation is not complete until we have confirmed it, so if you have not received confirmation, contact us.
6. When cancellation takes effect
6.1 Your cancellation takes effect as soon as we have processed it. From that moment, no further renewal payments are taken and no further Subscription Orders are supplied.
6.2 To stop your next Subscription Order, your cancellation must reach us at least 5 days before your next renewal date, calculated by reference to Eastern European Time. A cancellation reaching us later than that takes effect after the upcoming billing cycle: that cycle is charged and delivered, and no cycle after it is charged or delivered.
6.3 Where a Subscription Order has been charged but has not yet been packed or committed to fulfilment when your cancellation reaches us, we may stop it and refund the charge if our fulfilment process still allows. Contact us as soon as possible if you would like us to try, and we will tell you promptly whether it has been possible.
7. What cancellation does and does not do
7.1 Cancelling ends future renewals in accordance with Section 6 and affects future Subscription Orders and charges.
7.2 Cancelling does not, by itself, cancel or refund an Order that has already been charged or has genuinely entered processing, and it does not by itself entitle you to a refund of a Product already dispatched. Any return or refund relating to such an Order is handled under the Returns & Refunds Policy for your country. This does not limit any rights you may have concerning: (a) an unauthorized, duplicate or incorrect charge; (b) a delayed or missing Order; (c) a damaged, defective, unsafe or incorrect Product; or (d) any statutory right to withdraw from or cancel a particular Order.
7.3 Cancelling does not change the price of Products you have already purchased. A Product bought at a proportionate Subscription price will not later be repriced at its higher standalone price because you cancel, return another Product or request a partial refund. You will not be required to pay the difference between the Subscription price and the standalone price, and we will not deduct that difference from any refund.
7.4 If you make a new purchase after your Subscription ends, that purchase will be charged at the price and in the currency shown at checkout at that time.
7.5 Cancelling does not affect any right or obligation that had already accrued before it took effect, including any refund or remedy to which you had already become entitled.
8. Failed payments
8.1 If we cannot complete a recurring payment, for example because your card has expired or there are insufficient funds, we will notify you and may retry the payment a reasonable number of times.
8.2 You can update your payment details by contacting support@asuno.com or at your account.
8.3 We will not supply a Subscription Order until payment for that Order has been received. If payment is not completed, no Products will be supplied for that period and you will not owe the price of that Order.
8.4 If payment remains unsuccessful after reasonable attempts, we may pause or cancel your Subscription, and we tell you if we do. We do not charge a failed-payment fee or a fee to restart a Subscription.
9. When we may suspend or cancel a Subscription
9.1 We may suspend or end a Subscription where:
- payment repeatedly fails;
- we reasonably suspect fraud or unauthorized use of a payment method;
- promotional offers, return procedures or refund procedures are being misused;
- Products are being resold or used contrary to the personal-use provisions in the Terms of Sale;
- a Product is discontinued or unavailable;
- we can no longer deliver to your address or country;
- we are required to do so by law; or
- you seriously or repeatedly breach the Terms of Sale.
9.2 We will act reasonably and notify you when we suspend or cancel a Subscription, including the reason where we are able to provide it.
9.3 We will not keep payment for Products that we will not supply. If we have already charged you for an Order that we do not fulfil, we will refund the amount paid for that Order.
9.4 A Suspension or cancellation by us does not affect any return, refund or other right that arose before the Subscription ended.
10. Changes to the Subscription price or other material terms
10.1 The recurring price and other terms shown to you at checkout apply to your Subscription until we tell you otherwise. A change to our prices or offers takes effect only from the time it is published and never applies retroactively to a payment already taken or an Order already placed.
10.2 We do not reserve a right to change your recurring price or any other material term of your Subscription without notice. If we propose such a change, we tell you in advance by email, in a form you can keep, stating the change, the new price where the price is changing, the date from which it applies, and how to cancel before then. We give at least 14 days’ notice, or a longer period where the law that applies to you requires one, and where that law requires notice within a defined window before the change takes effect, we send it within that window.
10.3 You may cancel at any time before the change takes effect, using Section 5, and the new price or term will not apply to you. Where the law that applies to you requires your express consent to a price change or another material change, we obtain that consent before it applies, and we do not treat your silence or continued inactivity as consent.
11. Introductory and promotional pricing
11.1 If a Subscription begins with an introductory or promotional price, we will tell you before you subscribe: (a) what that price is, (b) how long it applies, (c) the recurring price that applies afterwards, and (d) the date on which the first charge at that later price will be taken.
11.2 You may cancel at any time before that charge, using Section 5 and subject to clause 6.2 where it applies to you. Where the law that applies to you requires a reminder notice before a free trial, promotional period or discounted-price period ends, we send it.
11.3 Products supplied at a proportionate Subscription price are paid Products and are not described as free.
11.4 We do not recover a promotional or introductory discount after you cancel. There is no minimum commitment attached to our Subscriptions, and where a discount is announced for a stated period, we honour it for that period.
12. Changing, pausing or restarting a Subscription
12.1 Instead of cancelling, you can ask us to change the frequency, quantity, delivery address or payment method of your Subscription, or to pause it, by contacting us at support@asuno.com or at your account.
12.2 A requested change will apply from the next renewal that has not already entered processing.
12.3 After cancelling, you may start a new Subscription through our Website. A new Subscription is a new agreement on the price and terms disclosed at checkout at that time and requires your affirmative consent in the same way as any other Subscription. A promotional price you have already used, such as a first-time-buyer discount, may no longer be available.
12.4 Cancelling a Subscription never affects your rights in relation to Products already supplied. You do not need to cancel in order to claim a remedy for a faulty, damaged, incorrect or non-conforming Product, and cancelling does not waive a claim you have already made. Those rights are set out in the Returns & Refunds Policy for your country.
12.5 If you believe you have been charged after cancelling, charged an incorrect amount, or charged twice, contact us at support@asuno.com with the date and amount. We investigate promptly and correct genuine errors, including duplicate charges, without delay. Nothing in this Policy asks you to give up your right to dispute a payment with your bank, card issuer or payment provider, and filing a dispute does not end your rights under this Policy or under applicable law. We ask you to contact us first so that we have a fair chance to put the matter right, which is usually faster, and the Returns & Refunds Policy for your country explains how we handle a refund and a payment dispute concerning the same amount so that it is not recovered twice.
13. Additional provisions for particular countries
13.1 European Union, European Economic Area and United Kingdom. Separately from cancellation, you have a statutory right to withdraw from an Order/Subscription within 14 days, which applies to each Subscription delivery and, under our Terms of Sale, to any Product whose seal is intact; it is explained, together with the online withdrawal function and the model withdrawal form, in the Returns & Refunds Policy. If we cannot settle a complaint with you, you may submit it to the Consumer Disputes Committee (Tarbijavaidluste komisjon) operating under the Estonian Consumer Protection and Technical Regulatory Authority, Endla 10a, 10122 Tallinn, Estonia, email info@ttja.ee, telephone +372 667 2000, www.ttja.ee, and you may also raise the matter with the consumer authority, consumer advice service or court of the country where you live.
13.2 United States. There is no general federal right to cancel an online purchase or to return it because you have changed your mind, and nothing in this Policy creates a 14-day withdrawal right for U.S. customers. State laws on automatic renewal and continuous service offers vary, and you keep all rights available under the law of your state that cannot be waived, including any rights under your state’s automatic renewal law; customers in California retain all rights under California’s Automatic Renewal Law, including its requirements on clear and conspicuous disclosure, affirmative consent, retainable acknowledgments, notices and cancellation. Where the law of your state requires advance notice of a renewal, of the end of a free trial or promotional period, or of a price change, we send that notice within the period that law requires. Where the law of your state requires a cancellation to take effect sooner than clause 6.2 provides, that requirement applies instead. If we ship a Subscription Order after your cancellation has taken effect, we refund it and do not require its return, and where the law of your state provides that goods sent in those circumstances may be kept as an unconditional gift, that law applies. You may contact the consumer protection authority in your province, territory or state.
13.3 Canada and Australia. There is no general nationwide cooling-off period in Canada for online purchases, and no general statutory change-of-mind period in Australia for an ordinary online purchase; nothing in this Policy creates a 14-day withdrawal right for customers in these countries. In Canada, you keep the rights available under the consumer protection and sale of goods legislation of your province or territory. Where the law of your province, territory or state requires a cancellation to take effect sooner than clause 6.2 provides, or entitles you to cancel a renewal at any time, that requirement applies instead. You may contact the consumer protection authority in your province, territory or state, and Australian customers may contact the Australian Competition and Consumer Commission or their state or territory fair trading office.
14. Complaints, governing law, changes and contact
14.1 If you are unhappy with how we have handled a cancellation or a billing matter, contact us at support@asuno.com and we will do our best to settle it quickly and fairly.
14.2 The governing law and dispute resolution provisions applying to your Subscription are set out in the Terms of Sale for your country. Any mandatory consumer rights that cannot legally be excluded will continue to apply.
14.3 We may update this Policy to reflect changes in our Subscription options, processes or applicable law. The version applying to a Subscription Order is the version published when that Order was placed.
